Notice of Public Registry Requirements for Certain Planning and Zoning Actions in Accordance with P.A. 06-80

Public Act 06-80 requires that the Town of Plainville provide notification that a public registry has been created to notify landowners, electors, and non-profit organizations qualified as tax exempt organizations under the provisions of Section 501 (c) of the Internal Revenue Code of 1986, or any subsequent corresponding internal revenue code of the United States, as from time to time may be amended, of the following pending actions:

Adoption or change in any zoning regulation.

Adoption or change in any zoning map boundary.

Adoption or change in any subdivision regulation.

Preparation, adoption or change to the Town Plan of Conservation and Development.

Under the act, Section 8-7(g) of the Connecticut General Statutes was revised to require that persons requesting such notice be placed on the "registry" at their request, and that notification be made by mail or electronic mail (email) if available. The act also specifies that the municipality shall not be civilly liable for errors or omissions through a bona fide error that occurs despite reasonable procedures maintained by the Town of Plainville.

Eligible entities wishing to register must do so in writing. The request must include a statement indicating eligibility and how the notice is to be given (regular or electronic mail). Please note that the Town is capable of providing email notification and prefers that method. After three years, the entity is removed from the registry unless a request is received in writing to remain on the registry for an additional period not to exceed three years. Such requests may be submitted at the end of any three year registration period.
